Welcome to ShiftingVision and the ShiftingVision NFT Platform (the “Platform”). This Platform is operated by Shifting Vision Ltd., with its registered address at 12 Triq San Gwann, Sqaq Numru 2, Siggiewi SGW 1471, Malta (“ShiftingVision”, “we” or “us”). ShiftingVision provides the use of this Platform, as detailed in the Terms and Conditions page, subject to the Privacy Policy set forth below. This Privacy Policy forms part of the Terms and Conditions of ShiftingVision.

ShiftingVision is committed to protecting and placing the utmost importance on your privacy. We also pledge to only make legitimate and reasonable use of your information for the purpose of providing ShiftingVision’s services, and not to misuse any information. We will only use information with your consent, unless permitted or required by law, or in order to prevent abuse of the Platform.

This Privacy Policy explains ShiftingVision’s online information practices concerning the personal data that we collect from you, or that you have provided to us; and assists you in making informed decisions when interacting with ShiftingVision, its created Art, or its mined NFTs (please see our Terms & Conditions page).

The use of the Platform is only intended for users above the age of 18. If you are below the age of 18, you promise that you are using the Platform with the consent and assistance of your parent or legal guardian.

Please read this Privacy Policy carefully. By using the ShiftingVision Platform, you agree to the Privacy Policy. If you do not agree with any section of this policy, you should not use the Platform.

1. The types of personal data we use

Personal data is any non-publicly available information which enables a natural person to be identified.

We collect and use only the following information about you:

Your Profile Information: You give us information if you register for an account on the Platform, including your username, password, date of birth (where applicable), email address and/or telephone number, your unique consumer identifier number, information you disclose in your user profile and your profile photograph or video.

Technical information we collect about you: We do collect certain information when you access our website and/or our Platform, such as your device’s IP address, browser information, the pages of our website or Platform that you visit, the time logs of your visit and interactions, the time you spent on those pages, unique device identifiers and other diagnostic data. If you access through a mobile device, we may also collect certain information automatically, including but not limited to, the type of mobile device you use, your mobile device unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile internet browser you use, unique device identifiers and other diagnostic data. We may also collect information that your browser sends whenever you visit or interact with our service, website and Platform by or through a mobile device.

All of this technical information will only be used to process interactions and applicable purchases on our website and our Platform; and to enhance your viewing and purchasing experience on our website and our Platform. We will also use these information from time to time to fulfil an official legal obligation, but only on an as-needed basis.

On-platform purchases: Your purchase will be made via connecting your Blockchain wallet. We do not collect any financial or billing information from you in relation to any transaction on the ShiftingVision platform. Please review the relevant portal’s terms and notices in respect of the handling of such data. So that we can provide you with the most updated transaction history, we keep a record of the details of purchases and sales you make, the time at which you make those purchases and the amount spent. Please also note the provisions of our Terms & Conditions page.

Information from Third Parties: You may choose to share certain pieces of data with us from third parties or through your use of the Platform, and we may collect such third party data automatically.

Proof of your identity: We sometimes ask you to provide proof of identity in order to ascertain that you are in fact the confirmed seller or purchaser of certain pieces of Art, or NFTs, or as required by any law, rule, or regulation.

2. Cookies

We use cookies and other similar technologies (“Cookies”) to automatically collect information, measure and analyze how you use the Platform to enhance your user experience and improve our services. Cookies enable the Platform to provide certain features and functionality. By using the Platform, you consent to our use of Cookies.

You may be able to refuse or disable Cookies by adjusting your browser settings. Because each and every browser is different, please note the specific instructions provided by the browser you are using. Please also note that you may need to take additional steps to refuse or disable certain types of Cookies. If you choose to refuse, disable, or delete Cookies, certain aspects of the functionality on the Platform may no longer be available to you.

3. How we use your personal data

We will use the information we collect about you in the following ways:

  • Communicate with you;
  • Provide you with user support;
  • Notify you about changes to our service;
  • Enable you to participate in the sales and/or auctions on the Platform;
  • Allow you to participate in interactive features of the Platform;
  • Facilitate the sales, auction, promotion and purchase of goods and services on our Platform.
  • Administer the Platform including troubleshooting;
  • Enable our systems to recognize and verify you through 3rd party provided middleware;
  • To protect the domain and network security of the Platform, and to enable user authentication;

  • For medical, historical, statistical, analytical, and research purposes (but only after anonymization);
  • Ensure content is presented in the most effective manner for you and your device;
  • Provide you with location-based services (where such services are available in your jurisdiction); and to
  • Enforce our terms, conditions, and policies.

4. How we share your personal data

All the information collected may be accessed only by ShiftingVision authorized employees, and we do not transfer any data collected to any entity outside of ShiftingVision.

We want to assure you that we only use the information you have provided us for the purposes in Section 3. ShiftingVision will only process and/or store your information with third parties as required for the supply for the ShiftingVision Platform services, including improving, offering related products and services or others, and to notifications and/or providers of products and/or similar service providers, and for the provision of product or service on the Platform.

5. Where we store your personal data

The personal data we collect from you will be stored safely and securely within our servers, or in secure Interplanetary File System servers (“IPFS” servers).  These will be in line with appropriate technical and organizational protection standards so that the assets remain confidential, secure and available.

6. Your rights and choices

The accuracy and completeness of your information is wholly dependent on the information provided by you. You may at any time request ShiftingVision to provide them access to the personal data collected with respect to yourself until such time the information is changed or deleted, unless otherwise precluded by Law.

You may also be afforded rights in your jurisdiction under applicable laws such as the ability to obtain a copy of your data, correct your data, delete your data, and potentially others, such as the right to data portability, the right to not be subject to automatic processing, or the right to be forgotten. You can at any time withdraw your consent to the collection, use, disclosure or storage of your information by giving reasonable notice to ShiftingVision. You can also at any time ask ShiftingVision to be removed from any mailing list, including by clicking on the “Unsubscribe” link at the bottom of each email message sent by ShiftingVision.

You can access and edit most of your information by signing into your account on our Platform. We also provide a number of tools in your Settings that allow you to control, among other things, who can see your information. Should you choose to do so, you may also delete your entire user account in Settings. If you prefer, you can also contact the Data Protection Officer to do so, referenced in Section 10 below.

Upon this withdrawal or consent, or by any other case of termination of ShiftingVision’s services, ShiftingVision will cease collection and/or using your information, unless otherwise required or authorized by law.

7. The security of your personal data

We have taken utmost steps to ensure that your information is treated securely and in accordance with this policy, by making reasonable security arrangements to prevent unauthorized access, loss or alteration to your information. We will also require all our service providers, if applicable, to do the same through strict contractual agreements. Nevertheless, it must be noted that the transmission of information via the Internet can never be completely airtight. Although we will strive to protect your personal data, for example, by encryption, we cannot guarantee the security of your information transmitted via our Platform; any transmission should be at your own awareness.

We pledge that we have appropriate technical and organizational measures and policies to ensure a level of security appropriate to the risk presented in relation to these data. We constantly maintain and update these technical and organizational measures and will check them from time to time to improve the overall security of our systems.

Additionally, access to the user accounts on the platform will be password-protected, and are meant to be confidential and for personal-use only. You must properly log-off from the account and close the browser in order to maintain the protection. ShiftingVision shall not be liable for any invasion of privacy or any other harm caused by the use of unauthorized username and personal password. It is your responsibility to safeguard the password, and you agree not to hold ShiftingVision responsible for any damage or loss caused due to failure to comply with the above.

We will, from time to time, include links and referrals to and from the websites of third parties. If you follow a link to any of those websites, please note that these entities have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies thoroughly before you submit any information to those websites.

8. How long we keep your personal data

We retain your information for only as long as necessary to provide you with the service on the Platform. Where we do not need your information in order to provide the service to you, we retain it only for so long as we have a legitimate business purpose in keeping such data. However, there are occasions where we are likely to keep this data for longer in accordance with our legal obligations, or where it is necessary for the establishment, exercise or defence of legal claims.

9. Changes to the Privacy Policy

ShiftingVision reserves the right to change this Privacy Policy at any time. Such change will be effective ten (10) days following the posting of the revised Privacy Policy on the Platform, and your continued use of ShiftingVision’s Platform thereafter means that you accept and agree to those changes.
